"Intellectual property" is no longer as intellectual as you once thought it was.

The U.S. Patent and Trademark Office shows a registration filed January 14, 2013, to trademark "Kaepernicking," the braggadocio move invented by San Francisco 49ers quarterback Colin Kaepernick.

For those not in the know, to Kaerpernick, do the following:

A. Get a badass bicep tattoo.

B. Become quarterback of the San Francisco 49ers (this is debatably the hardest step of this process).

C. Score a touchdown.

D. Kiss your tattoo (leave faceguard on).

Kaepernick intends to use the trademark to make T-shirts, and some of the proceeds from the Sportique "Kaepernicking" line will go to CampTaylor, which organizes camps for children afflicted with congenital heart defects.

How much money will Kaepernicking generate for the QB? Forbes takes a self-described "myopic" focus on whether the income will qualify as income or capital gains.

For all their financial analysis, however, whether Kaepernick makes bank on his trademark probably comes down to a much more obvious point of contention:
