James Eagan Holmes: Aurora Shooter to Plead Guilty to Avoid Death Penalty

James Eagan Holmes, the accused Aurora, Colorado, movie theater shooter, who on July 20, 2012, stormed into a midnight show of Christopher Nolan's Dark Knight Rises killing 12 people and injuring 58 others, may plead guilty in a bid to avoid the death penalty — reported the NYDN. 

But, according to The Coloradoan, a filing released Wednesday revealed the prosecution is not ready to accept the deal that would allow Holmes to live in prison for the rest of his life. Instead, they reportedly want to pursue the death penalty.

Earlier this month, a judge entered a not guilty plea on behalf of Holmes, whose defense spent months trying to convince the jury that Holmes is insane — as he sported bright orange hair and reportedly tried to kill himself by banging his head against his cell's walls. 

But now, prosecutors say the accused Aurora shooter, who now wears brown hair and a bushy beard, can't prevail with an insanity plea "because he planned the massacre for months, amassing an arsenal of high-powered weapons and booby-trapping his apartment to kill anyone who tried to enter after the mass shooting." A trial is currently scheduled to begin on August 5.
