The Supreme Court decided yesterday that companies cannot patent naturally occurring genes but can own the rights to lab-created versions, in the case of Molecular Pathology v. Myriad Genetics. Myriad wanted the exclusive right to research two genes it discovered that are linked to breast and ovarian cancer. Angelina Jolie underwent a double mastectomy earlier this year after discovering she had a mutation of one of the genes. Both sides in the case claimed victory after the decision. “Because of this ruling, patients will have greater access to genetic testing and scientists can engage in research on these genes without fear of being sued,” said Sandra Park, a lawyer with the ACLU. Myriad stock rose as much as 12.8% before falling later in the day.
