Hollingsworth v. Perry Decision: Read the Full Transcript Here

Wednesday morning, the Supreme Court decided Hollingsworth v. Perry, California's Proposition 8 case. The Court ruled that petitioners don't have standing, and therefore it doesn't have jurisdiction to rule on the issues involved. The decision of the Ninth Circuit is vacated and remanded, meaning gay marriage is legal in California.

At oral arguments, some of the first questions from the justices were on the issue of standing and many court watchers anticipated that of the two same-sex marriage cases (the other being DOMA), this was the most likely to have a procedural issue.

"We have never before upheld the standing of a private party to defend the constitutionality of a state statute when state officials have chosen not to. We decline to do so for the first time here," reads the 5-4 majority opinion.
