NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR PARTICIPATE. The PolicyMic Open Mic (the "Open Mic") is sponsored by Mic Network, Inc., a Delaware corporation d/b/a PolicyMic, with principal offices located at 35 West 36th Street, 9th Floor West, New York, NY 10018 ("PolicyMic"). 

ELIGIBILITY: 

Subject to these Official Rules, the Open Mic is open only to (i) permanent legal U.S. residents physically residing in the fifty (50) United States of America and the District of Columbia, (ii) who are at least eighteen (18) years old as of the date of entry and (iii) who either have an existing PolicyMic account ("Account") or who connect PolicyMic to their Facebook account via Facebook Connect. Employees of PolicyMic, and their respective parents, affiliates, subsidiaries, and advertising and promotion agencies and any other entity involved in the development or administration of this Open Mic, and their immediate family members or household members are not eligible to participate in the Open Mic. THE OPEN MIC IS VOID WHERE PROHIBITED OR RESTRICTED BY LAW OR WHERE BONDING, REGISTRATION, OR OTHER REQUIREMENTS WOULD BE REQUIRED BUT HAVE NOT BEEN MET, OR WHERE THE METHODS OF ENTRY SET FORTH BELOW WOULD BE DEEMED CONSIDERATION. ALL APPLICABLE FEDERAL, STATE AND LOCAL LAWS APPLY.

AGREEMENT TO OFFICIAL RULES:

By participating in the Open Mic, you fully and unconditionally agree to and accept these Official Rules and the decisions of PolicyMic, which are final and binding in all matters related to the Open Mic.  Whether an entrant receives a prize is contingent upon fulfilling all requirements set forth herein. 

TIMING:

The Open Mic begins December 4, 2013 at 11:00 AM Eastern Daylight Time ("EDT") and ends December 11, 2013 at 11:59 PM Eastern Daylight Time ("EDT") (the "Open Mic Period").  The Open Mic consists of three (3) categories, Local Education, National Engagement, and Policy Proposals (each a "Category").

HOW TO ENTER:

No purchase or payment is necessary to participate in the Open Mic. During the Entry Period, you may enter the Open Mic by:

Logging into your Account via Facebook Connect; and Going to http://www.policymic.com/open-mic/healthcare and following the instructions regarding entering a submission in an applicable Category.  In brief, each submission must include the following elements:

A title (90 max characters, including spaces ) A summary of your proposal (min 100 to max 1000 characters, including spaces)

An entrant can make at most one submission per Category, for a total of three submissions maximum.

By making a submission, you agree that each submission and any other information provided by you or collected by PolicyMic in connection with the Open Mic may be used by PolicyMic in accordance with PolicyMic's Privacy Policy at http://www.policymic.com/articles/75371/mic-network-privacy-policy and may be shared with PolicyMic's affiliated business entities and other prize providers or sponsors of this Open Mic.  You also warrant and agree that each submission is original and does not infringe the intellectual property rights of any third party.  You also acknowledge that Facebook is a third party service with which PolicyMic is not affiliated, and any content or information you provide through these services is subject to the terms of use and privacy policy of that service.

MODERATION & VOTING:

PolicyMic will review each submission to ensure it complies with these Official Rules and the PolicyMic Terms of Service http://www.policymic.com/articles/75387/mic-network-terms-of-service and reserves the right to provide light copy edits and headlines (but will not make any large substantive revisions to the submission).  PolicyMic reserves the right, in its sole discretion, to reject any submission for any reason or no reason at all.  PolicyMic expressly reserves the right to disqualify any submission(s) that it believes in good faith are generated by an automated means or scripts.  Submissions that are forged, altered, or generated by script, macro, or other automated means are void. 

Submissions properly submitted in accordance with these Official Rules and reviewed by PolicyMic shall be published at www.policymic.com/open-mic/healthcare/submissions for public voting by other PolicyMic users who have an Account or who have logged into PolicyMic via Facebook Connect (each a "Registered User") and will compete in the three Categories.

Other PolicyMic users (who have logged into PolicyMic via Facebook Connect) will be able to read each submission in each Category and vote for the ones they support. 

Voting for each respective Category closes as of 12:00 PM EST on December 11, 2013. Votes are counted by how many "Mics" (similar to an upvote) a submission has received in each Category.  This helps prevent a single Registered User from voting more than once per submission.  However, there is no limit with respect to the number of submissions a Registered User can vote for within a Category or across Categories.  For clarity, only Registered Users shall be able to vote on submissions to the Open Mic. 

Once the Voting Deadline has passed, PolicyMic will note the number of Mics received by each submission within that Category.  The submission with the most Mics in a Category will be sent to White House with a request for response.

The Open Mic will be conducted under the supervision of PolicyMic. The decisions of PolicyMic are final and binding in all matters relating to this Open Mic. If a Category Most Mic'd is found to be ineligible for any reason at all, an alternate Most Mic'd may also be selected from the pool of eligible submissions for that particular Category.

PRIZES:

The most Mic'd submission from each Category, that meets PolicyMic's approval, will be submitted to the White House, who may or may not respond by January 30, 2014.

Decisions of PolicyMic are final and binding with respect to all matters related to the Open Mic. In no event shall PolicyMic be obligated to award any prizes other than the prizes specified in these Official Rules. The prizes are non-transferable and no substitutions (including, without limitation, for cash) are permitted, except that PolicyMic reserves the right to substitute a prize of equal or greater monetary value for any prize if such prize should become unavailable for any reason.  

MOST MIC'D' LIST:

To receive a complete list of Most Mic'd or a copy of the Official Rules, within six (6) months after the end of the Entry Period, send a self-addressed stamped envelope to Mic Network, Inc. d/b/a PolicyMic, at 35 West 36th Street, 9th Floor West, New York, NY 10018.

GENERAL CONDITIONS AND RELEASES:

By entering the Open Mic or accepting a prize, you agree to conform to all federal, state and local laws and regulations.

Unless prohibited by applicable law, any submission you provide to enter the Open Mic constitutes your permission to use such submission along with your name, photograph, likeness, voice, address (city and state) and testimonials in all media, in perpetuity, in any manner PolicyMic deems appropriate for publicity purposes without any compensation to you or any review or approval rights, notifications, or permissions; and constitutes your consent to disclose your personally identifiable information to third parties (including without limitation placing an entrant's name on a Most Mic'd' list). Furthermore, you represent and warrant that you (i) possess all rights in the submission necessary to grant the foregoing rights and (ii) have obtained all consents and releases necessary for PolicyMic to use the submission as contemplated in these Official Rules without payment of any kind to any third party.

An entrant may be disqualified from the Open Mic if he or she fails to comply with each provision of these Official Rules, as determined in the sole discretion of PolicyMic. Participation in the Open Mic is at your own risk. PolicyMic shall not be liable for: (1) failed, returned or misdirected notifications based on inaccurate information provided by an entrant in connection with a submission; (2) entries and responses to notifications which are lost, late, incomplete, illegible, unintelligible, postage-due, misdirected, damaged or otherwise not received by the intended recipient in whole or in part or for computer or technical error of any kind; (3) any electronic miscommunications or failures, technical hardware or software failures of any kind, lost or unavailable network connections, or failed incomplete, garbled or delayed computer transmissions which may limit an entrant's ability to participate in the Open Mic; (4) any technical malfunctions of the telephone network, computer on-line system, computer equipment, software, program malfunctions or other failures, delayed computer transactions or network connections that are human, mechanical or technical in nature, or any combination thereof, including any injury or damage to an entrant's or any other person's computer or mobile device related to or resulting from this Open Mic; or (5) any warranty with respect to any prize or any component thereof. THE PRIZES ARE AWARDED "AS IS" AND POLICYMIC DOES NOT MAKE ANY, AND HEREBY DISCLAIMS ANY AND ALL, REPRESENTATIONS OR WARRANTIES OF ANY KIND REGARDING THE PRIZES.

NOTWITHSTANDING ANYTHING ELSE HEREIN OR OTHERWISE, NEITHER POLICYMIC NOR ANY PRIZE PROVIDERS HEREUNDER SHALL BE LIABLE OR OBLIGATED WITH RESPECT TO ANY SUBJECT MATTER OF THIS AGREEMENT OR UNDER CONTRACT, NEGLIGENCE, STRICT LIABILITY OR OTHER LEGAL OR EQUITABLE THEORY FOR (A) ANY SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES (INCLUDING, WITHOUT LIMITATION, LOSS OF REVENUE, GOODWILL, OR ANTICIPATED PROFITS), (B) DATA LOSS OR COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, AND/OR (C) ANY MATTER BEYOND ITS REASONABLE CONTROL.

By entering the Open Mic, you agree to and hereby do release and hold harmless PolicyMic, any Open Mic prize providers and each of their respective parents, subsidiaries and affiliated entities, directors, officers, employees, attorneys, agents, and representatives from any damage, injury, death, loss, claim, action, demand, or other liability (collectively, "Claims") that may arise from your acceptance, possession and/or use of any prize or your participation in this Open Mic (including, but not limited to, any third party claims of intellectual property infringement or violation of rights of privacy or publicity with regard to the submission when used by PolicyMic in accordance with these Official Rules), or from any misuse or malfunction of any prize awarded, regardless of whether such Claims, or knowledge of the facts constituting such Claims, exist at the time of entry or arise at any time thereafter. Any person attempting to defraud or in any way tamper with this Open Mic may be prosecuted to the full extent of the law. PolicyMic reserves the right to modify these Official Rules in any way or at any time. PolicyMic reserves the right, in its sole discretion, to cancel or suspend this Open Mic should viruses, bugs or other causes beyond their control corrupt the administration, security or proper operation of the Open Mic. In the event of cancellation or suspension, PolicyMic shall promptly post a notice on PolicyMic's website to such effect. This Open Mic shall be governed by New York law, without regard to conflicts of laws provisions. By participating in this Open Mic, you agree that any dispute or litigation arising from or relating to this Open Mic shall be determined by binding arbitration only in New York, NY, by and under the Streamlined Arbitration Rules and Procedures of JAMS, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.   Notwithstanding the foregoing, PolicyMic may seek equitable relief in any court of competent jurisdiction.  If any provision of these rules is held to be illegal or unenforceable, such provision shall be limited or eliminated to the minimum extent necessary so that these rules otherwise remain in full force and effect and enforceable.
